Who is the Data Controller?
The controller of your personal data is FUNDACJA ROZWOJU PRZEDSIĘBIORCZOŚCI „TWÓJ STARTUP” based in Warsaw (registered address: ul. Żurawia 6/12, loc. 766, 00-503 Warsaw).
This privacy policy applies to the services provided by the Foundation through the organized part of the enterprise Joanna Musiał-Janicka Photography. Contact details: email address: joanna@musialjanicka.art, carried out by Joanna Musiał-Janicka.
Why do we process your data?
A. In connection with services provided via Joanna Musiał-Janicka Photography consisting of processing orders and customer inquiries i.e., for the purpose of concluding or performing a contract (Article 6(1)(b) of the Regulation), your data will be stored until the contract is fulfilled.
B. For marketing purposes and promotion of products offered by the Foundation, which constitute our legitimate interest (Article 6(1)(f) of the Regulation). Your data will be processed until you object.
C. To fulfill any legal obligations arising from the cooperation undertaken (Article 6(1)(c) of the Regulation). This includes obligations to retain certain documents for periods specified by law, e.g.:
- Accounting Act of 29 September 1994 (Journal of Laws of 2017, item 1858);
- Tax Ordinance Act of 29 August 1997 (Journal of Laws 1997, No. 137, item 926);
- Act of 1 March 2018 on counteracting money laundering and financing terrorism (Journal of Laws 2018, item 723).
D. To establish, pursue, or defend claims, which constitutes our legitimate interest (Article 6(1)(f) of the Regulation). Data will be processed until the limitation period for claims expires.
E. With your consent, data will be processed within the scope and purpose specified in the consent (Article 6(1)(a) of the Regulation). Data will be processed until consent is withdrawn.
What data is processed?
To conclude a contract, we require data provided in the contract/order form (if not provided, we cannot conclude the contract or perform the order). Additionally, we may request optional data which does not affect the conclusion of the contract (if not provided, e.g., we may not be able to call a contact number).
During the performance of the contract and while providing services, we may become aware of other personal data. The presence of your personal data with us results from the services you use.
Who will have access to your data?
A. Public authorities, to the extent that data is not obtained in the course of specific proceedings under the law (e.g., related to anti-money laundering).
B. Entities processing your personal data on behalf of the Foundation under a data processing agreement (so-called processors), e.g., Beneficiaries of the Foundation, IT specialists, archiving companies, hosting providers.
C. External data controllers (so-called parallel controllers) to whom data is provided, e.g., legal advisors, courier or postal companies, entities acquiring receivables in case invoices are not paid on time.
D. Entities outside the EEA, but only if necessary and ensuring an adequate level of protection, primarily by:
a. Cooperation with entities in countries for which an appropriate European Commission decision has been issued;
b. Application of the standard contractual clauses issued by the European Commission.
The controller always informs about the intention to transfer personal data outside the EEA at the time of data collection.
Is your data subject to profiling?
We inform you that your data will not be subject to profiling, i.e., automated analysis of your data to predict preferences or future behavior (profiling refers, for example, to marketing profiling to determine which offer may be of most interest based on your previous choices).
What are your rights?
A. Right of access to personal data processed by us (Article 15 of the Regulation).
B. Right to rectify the provided personal data (Article 16).
C. Right to erasure (“right to be forgotten”) – if you believe there is no legal basis for us to process your data, you may request its deletion (Article 17).
D. Right to restrict processing – you may request that we limit processing only to storage or performance of agreed actions if the data is incorrect, processed unlawfully, or you need it to establish, exercise, or defend legal claims (Article 18).
E. Right to data portability – you have the right to receive in a structured, commonly used, machine-readable format (e.g., .csv) the personal data we hold about you on the basis of a contract or consent. This applies to data held electronically; if only in paper form, this right does not apply. You may request direct transfer to another entity (Article 20).
F. Right to withdraw consent – you may withdraw consent for processing at any time, without affecting the lawfulness of processing carried out based on consent before withdrawal (Article 7(3)). Withdrawal is done by sending an email to: joanna@musialjanicka.art.
G. Right to object – you may object to processing if the legal basis is our legitimate interest (Article 21). After consideration, we will stop processing unless we demonstrate overriding legitimate grounds.
H. Right to lodge a complaint with the supervisory authority, i.e., the President of the Personal Data Protection Office, if you believe your data is processed unlawfully.

How long I retain your data?
If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.
For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
